These Terms of Service ("Terms") govern your access to and use of Hofaso Technologies' ("we", "us", or "our") website and services available via www.hofaso.com.

1. Acceptance of Terms

By accessing or using our services, you agree to be bound by these Terms in their entirety. Should you disagree with any provision contained herein, your sole recourse is to immediately discontinue use of our services. These Terms constitute a legally binding agreement between you and Hofaso Technologies.

2. Service Description

Hofaso Technologies provides AI-powered technology solutions including custom AI development services, Software-as-a-Service (SaaS) platforms, and technical support services. Our offerings are subject to modification or discontinuation at our sole discretion, and we reserve the right to update service features without prior notice while maintaining core functionality as described on our platform.

3. User Responsibilities

Users must be at least 18 years old to create an account and utilize our services. You are required to maintain accurate and complete account information at all times, and immediately notify us of any unauthorized use of your credentials. All users must comply with applicable laws and regulations, refraining from any activity that could damage, disable, or impair our services or interfere with other users' access.

4. Intellectual Property

All intellectual property rights in our software, trademarks, service content, and underlying technology remain the exclusive property of Hofaso Technologies. Users are granted a limited, non-exclusive, non-transferable license to access and use our services strictly in accordance with these Terms. User-generated content submitted through our platforms remains your property, though you grant us a worldwide license to use, reproduce, and display such content for service delivery and improvement purposes.

5. Payments & Fees

Subscription fees for our services are billed monthly or annually in advance, with payment processing handled through secure third-party providers. All fees are non-refundable except as expressly stated in our refund policy. We reserve the right to modify pricing structures with 30 days' notice to active users, provided through email or platform notifications.

6. Termination

Either party may terminate service access with written notice. We may immediately suspend or terminate accounts for material breaches of these Terms, including but not limited to fraudulent activities, payment failures lasting more than 15 days, or unauthorized distribution of service content. Upon termination, all license rights granted herein will immediately cease.

7. Disclaimers

Our services are provided "AS IS" without warranties of merchantability, fitness for particular purpose, or non-infringement. While we employ industry-standard security measures, we cannot guarantee uninterrupted or error-free service operation. Users acknowledge that AI-powered solutions may produce variable outputs and assume full responsibility for their use of generated content.

8. Limitation of Liability

In no event shall Hofaso Technologies be liable for indirect, incidental, special, consequential, or punitive damages arising from service use, including but not limited to lost profits, data loss, or business interruption. Our total liability for any claims under these Terms shall not exceed the fees paid by you during the six-month period preceding the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal actions or proceedings arising from these Terms shall be exclusively brought in the courts of Ernakulam, Kerala, and both parties consent to personal jurisdiction in these courts.

10. Modifications

We reserve the right to modify these Terms at any time, with changes becoming effective upon posting to our website. Continued use of services after modifications constitutes acceptance of revised Terms. Material changes will be communicated through registered email addresses or prominent website notices at least 15 days prior to implementation.
